Be it ordained by the mayor and council of the City of Marion Centre that any person found under the influence of intoxicating liquor within the corporate limits of the City Of Marion Centre . . . or shall be found indulging in boisterous, profane, or obscene language . . . shall be subject to a fine of not less than $1 nor more than $10.
In the event of non-payment of fine and costs, the party so convicted shall be put at labor upon the streets under the charge of the street commissioners and should be allowed the rate of $1 for each and every day of labor until the fine and cost should be duly paid.
