Hospital lawsuit trimmed

Emprise bank wins another round

Emprise Bank won a partial judgment May 28 in a lawsuit filed Feb. 9 to remove the rights of creditors with an interest in property of the former Herington Hospital and its clinics in Hillsboro and Junction City.

Some defendant companies were dismissed from the case.

The bank got default judgments against Canon Medical Systems USA, Inc., Landmark National Bank, and Mitsubishi HC Capital America, Inc. for not filing answers to the lawsuit.

The default judgments revoked any interest the companies had in the equipment.

Dismissed from the case were:

  • Americorp Financial, which released liens against equipment.
  • Century Business Systems, Inc. and Ortho-Clinical Diagnostics, Inc., which satisfied Emprise Bank that equipment within the hospital and clinics were leased by the hospital.
  • G L Real Estate Ventures, which told Emprise it would not assert a landlord’s lien.

The bank’s case against De Lage Landen Public Finance, First Financial Holdings doing business as First Financial Healthcare, and U.S. Bank National Association will continue.

The bank earlier was awarded the Hillsboro building in a separate mortgage foreclosure lawsuit.

In the current suit, it sought that its own security interest in the former hospital’s assets be found superior to the claims of any of the defendants.
